Trusts: Section 100A and Reimbursement Agreements

Introductory video outlining finalised public guidance covering Trusts, the application of section 100A and reimbursement agreements. 


Section 100A is an anti-avoidance provision, that describes ‘reimbursement agreements’ which arise where, for a purpose of avoiding tax, an entity is provided a trust distribution but someone else actually benefits.


We’ve provided this guidance, a Taxation Ruling and a Practical Compliance Guideline, to assist trustees and advisors to understand when there might be a reimbursement agreement and how we will apply our compliance resources.
